WHISTLEBLOWER FILES SEVEN JUDICIAL COMPLAINTS, CHALLENGING SYSTEMIC MISCONDUCT IN COLORADO COURTS AS NEW CHIEF JUSTICE MÁRQUEZ TAKES HELM

Will Justice Prevail? Colorado’s Judicial System Faces Scrutiny as Chief Justice Márquez Confronts Legacy of Misconduct Scandals and Severe Crises of Public Confidence
Rabbi Jacob Bellinsky, a crime victim, witness, whistleblower, and father of eight, has filed seven formal judicial complaints with the Colorado State Court Administrator’s Office (SCAO) over the past four weeks, bypassing the Commision on Judicial Discipline. The complaints allege egregious misconduct by at least 10 senior and non-senior judges across multiple courts, including former Colorado Supreme Court Chief Justice Brian D. Boatright.
These latest filings come after five years of what Bellinsky describes as “a hellish, traumatizing, and abusive nightmare” involving the unlawful separation from his children, denial of due process, wholesale deprivations of rights, and alleged criminal conduct against him and his family by various court officers and public officials. Bellinsky’s current complaints span the Colorado Court of Appeals, Supreme Court, and district courts, raising serious questions about the integrity of the state’s judicial system.
“The public is looking to the new Chief Justice Monica Márquez to actually do justice,” said Bellinsky. “To date, I have received no substantive response from State Court Administrator Steven Vasconcellos, nor have I yet been contacted by Chief Justice Márquez regarding these dire issues, despite confirmation from Vasconcellos that the chief justice is in receipt of my complaints and of my request for her direct response, leadership, and intervention as the executive head of Colorado’s Judicial Branch.”
Bellinsky’s complaints allege:
- Egregious prejudice, discrimination, and mishandling of cases
- Wholesale deprivations and violations of constitutional rights
- Disturbing breaches of judicial ethics and oaths of office
- Systemic failures in oversight and accountability
The complaints involve senior judges Dinsmore Tuttle, John Robert Lowenbach, and Theresa M. Cisneros, as well as multiple judges on the Colorado Court of Appeals and Supreme Court, and in Colorado’s 18th and 1st Judicial Districts.
Bellinsky, who was the primary caretaker of his children for over six years following his divorce ten years ago, has now been unlawfully separated from them for three years. Despite countless requests invoking the Crime Victims Rights Act and other forms of assistance and redress, Bellinsky and his children have received no crime victim services or assistance of any kind. Instead he has been retaliated against and every complaint he has filed has been denied, with officials even refusing to assign case numbers or open investigations.
“The neglect and disregard for the suffering of children and families goes to the highest levels of our government,” Bellinsky stated. “With the exception of Congressman Lamborn’s office, which has referred the egregious matters to the House Judiciary Committee’s whistleblower committee, not a single government office or court across all state and federal branches of government has assisted our victimized, traumatized, and broken apart family for profit. This includes Colorado’s former chief justice, the Supreme Court justice en banc, the Governor’s office, Attorney General Weiser, local district attorneys, local sheriffs, town and county boards, school districts, U.S. Attorneys, the FBI, CBI, and the federal courts, among others”
As a result of this ongoing manifest injustice and hellish ordeal, Bellinsky has lost everything – his family, his home, his livelihood, and his children. The state’s neglect and egregious misconduct have left him impoverished. Adding insult to injury, Bellinsky reports experiencing religious discrimination and cultural insensitivity towards his established Jewish family, for which he has worked and sacrificed his entire life, and following their move from Israel. Most painfully, he is now being denied the ability to attend his oldest daughter’s wedding in three weeks, and his youngest son of four sons was denied a Bar Mitzvah service, among other violations and deprivations of religious freedom and liberty.
Bellinsky currently has active cases before the Colorado Court of Appeals and Supreme Court, Elbert and Gilpin County courts, two pending federal lawsuits (1:23-cv-03163 and 1:23-cv-03461), and has filed seven formal state and federal criminal complaints (see links below) with top law enforcement who have neglected his pleas for assistance, crime victim services, and investigations.
“These complaints represent just one thread in a complex web of systemic and wilful failures Bellinsky added. “The question now is whether Chief Justice Márquez and the SCAO will take meaningful action to address these systemic issues and restore public trust in our courts.” He adds, “Our state is in a severe crisis, but everyone seems content to just continue sweeping these abuses under the rug to protect those directly responsible for our family’s ongoing suffering.” It’s high time our government works for the people and exercises its power to provide justice now, and not in another five years after my children are grown and forever irreparably harmed for remainder of their lives.”
